Terms & Conditions

These are the terms and conditions on which Judith Blacklock Flower School Limited (“we”, “us”, “JBFS”) provides Services to you, the Client. By booking a Course with JBFS, you agree to be bound by these terms and conditions.

 

Judith Blacklock Flower School is a private limited company incorporated and registered in England and Wales whose registered number is 03989934 and whose registered address is 52 Suffolk Road, London, SW13 9NR, United Kingdom.

 

JFBS is engaged in, amongst other activities, the supply of post-secondary non-tertiary education and cultural education relating to floral design and floral arrangement.

 

1.   Definitions and interpretation

1.1.  The capitalised terms used in these Terms and Conditions shall have the meanings and interpretation as set out below:

“Booking Form” – A physical document capturing the Client’s personal details and Course details, including Course Start Date following a booking that is retained by JBFS at its Physical Correspondence Address.

“Cancellation” – The notification, activities and associated process relating to a Client cancelling their booking for a Course.

“Cancellation Charge” – the charge applied by JBFS to fulfil a Cancellation and to be paid by the Client. This amounts to £75.00 unless otherwise stated.

“Client” – has the same meaning as “Student,”, namely you, to whom JBFS provides its Services in conjunction with these Terms and Conditions.

“Correspondence Address” – for the purposes of email and postal communications these are: school@judithblacklock.com and 4-5 Kinnerton Place South, Knightsbridge, London, SW1X 8EH. United Kingdom respectively.

“Course” – An In-Person Course or an Online Course

“Course Start Date” – The date on which a specific Course commences

“Days” – all days from Sunday to Saturday inclusive, including public holidays in England.

“Deposit” – a payment made by the Client to secure a place on a Course that is less that the Fees. For the avoidance of doubt, confirmation of booking will only be provided once the outstanding balance and hence Fees are paid.

“Fees” – the monies payable in full by a Client to JBFS for the provision of Products and Services.

“Floral Pack” – floral sundry materials and other materials that JFBS provides to Students enabling them to fulfil their On-Line Course.

“Gift Voucher” – a prepaid payment instrument issued by JBFS which the Client can use to purchase Services

“In-Person Course” – the provision of teaching, associated resources and materials by JFBS to fulfil various floral design and floral arrangement courses in person at 4-5 Kinnerton Place South, Knightsbridge, London, SW1X 8EH. United Kingdom, or at other physical locations from time to time deemed necessary by JFBS for the fulfilment of the training objectives.

“Online Course” – the provision of teaching, associated resources and materials accessed virtually by a Student to fulfil various floral design and floral arrangement courses online.

“Online Learning Platform” or “OLP” – the technical platform and web-based resources provided by JFBS to a Student for the teaching of an Online Course.

“Product” – Physical materials, such as books, magazines, and other literature that may be purchased by the Client from JBFS

“Services” – All Courses provided by the Judith Blacklock Flower School for its Clients.

“Transfer” – The notification, activities and associated process relating to a Client transferring their booking for a Course to a different Course.

“Transfer Charge” – the charge applied by JBFS to fulfil a Transfer and to be paid by the Client. This amounts to £75.00 unless otherwise stated.

“Week” – a period of seven [7] Days.

 

2.   Fees

2.1.  Full payment of the Fees for our Courses must be received prior to the commencement of your Course. Your place on the Course cannot be guaranteed until full payment is received. In instances where a Deposit has been paid, full payment of the balance must be received twenty-eight [28] Days before the Course Start Date.

2.2.  JBFS reserves the right to change the Fees with no notice. We will confirm prices during the booking and confirmation process. In the event that JBFS confirms a Course you have booked at an incorrect price due to error, we will notify you of the correct price and you will have the option of cancelling your booking.

2.3.  All fees are inclusive of VAT at the prevailing rate.

 

3.   Methods of payment

3.1.  Fees are to be paid in accordance with the following options:

3.1.1.       by payment (credit or debit) card personally at the school, over the phone or online.

3.1.2.       by UK cheque up to seven [7] Days before the Course Start Date. Please make all cheques payable to Judith Blacklock Flower School Ltd.

3.1.3.       by transfer to our bank account, details of which will be provided by JBFS to you upon request.

3.1.4.       by cash, if payment is made in person at the school and in accordance with the following conditions:

3.1.4.1.   if the amount is equal to, or over £500.00, you will be required to provide photo ID at the time of booking. This ID must be in the form of a valid be either a driving licence or passport, which we will photocopy and attach the copy to your Booking Form.

3.1.4.2.   any refunds associated with a Cancellation will require presentation of the exact same photographic ID attached to the Booking Form to collect the cash refund in person. This will be checked against the original ID provided before any cash is refunded.

 

4.   Non-UK students

4.1.  As we may need to contact you in the two weeks prior to the Course Start Date, please ensure you include your UK contact details when making your booking.

4.2.  Please ensure that your place is confirmed and the Course is running before you make any travel arrangements. Confirmation will be sent in an email by JFBS to the address you provided during booking We do not offer refunds for travel or accommodation costs.

 

5.   Visas

5.1.  If you do not hold a UK / EU / EEA passport you will need a visa that allows you entry to the UK to take one of our In-Person Courses. For information please see the UK Home Office website. It is your responsibility to determine how far in advance you need to apply for a visa and to allow sufficient time to obtain a visa.

5.2.  If you cannot attend a course because you have not obtained a visa to enter the UK no refund will be offered, although we will offer you a transfer if your visa is delayed.

 

6.   Cancellations

The following cancellation policy will apply to In-Person Courses:

6.1. You may cancel your place on a Course up to six [6] Weeks before the Course Start Date. Under these circumstances, you will have to pay a Cancellation Charge if you are unable to transfer to another Course. If you do not transfer, you will be refunded the Fees already paid less the Cancellation Charge.

6.2. If you cancel your place on a Course between two [2] and six [6] Weeks before the Course Start Date JFBS will be entitled to retain 50% of Fees already paid or the Cancellation Charge, whichever is the larger amount. You will be refunded any remaining balance.

6.3. If you cancel fourteen [14] or fewer Days before the Course Start Date there will be no refund.

6.4. Nothing in Paragraphs 6.1 to 6.3 of these Terms & Conditions affects your statutory rights as a consumer to cancel your booking during the period of fourteen [14] Days from the booking date (provided that the course has not completed) by notifying us by post or email to our Correspondence Address.

6.5. Further to Paragraph 6.4 above we will acknowledge your cancellation via email to the address you provided during booking and will refund all Fees paid within fourteen [14] Days of receiving your cancellation save that, if your attendance on the course has started, JFBS will be entitled to charge you for the Services that we have provided to you prior to your cancellation.

6.6. Please note that Courses have minimum attendance levels and may be cancelled if too few bookings are received. We, therefore, reserve the right to amend or cancel courses.

6.7. If we cancel a Course, we shall endeavour to give you a minimum of seven [7] Day’s notice from receipt of an email sent by JFBS to the address you provided during booking. You will have the option of transferring to another Course or of having a full refund of the Fees, which we will return to you within fourteen [14] Days.

6.8. We will not be liable for any losses (including, but not limited to, travel and accommodation costs) arising as a consequence of any modification or cancellation of Courses or timetabling constraints as set out above and beyond the Fees already paid for the Course.

The following cancellation policy will apply to Online Courses:

6.9. As per your statutory rights as a consumer, you may cancel your subscription to our Online Learning Platform within fourteen [14] Days of JBFS confirming your Online Course via email to the address you provided us during booking. JFBS will refund all Fees paid within fourteen [14] Days of receiving your cancellation.

6.10. JBFS will issue your OLP login details after the fourteen [14] Day ‘cooling off’ period expires. Should you request these details before expiry of the corresponding fourteen [14] Day period and access the platform during this period you acknowledge that your right to cancel is lost. For the avoidance of doubt ‘accessing the platform’ means the successful entry of your username and password to access our online training resources.

6.11. JBFS will refund all Fees less any costs associated with providing the Floral Pack, if applicable, within fourteen [14] Days of notification of cancellation by you in writing via email to our Correspondence Address.

 

7. Transfers

7.1. You may transfer onto another course up to six [6] Weeks before the Course Start Date. Under these circumstances, you will be permitted to transfer subject to a Transfer Charge to cover our administrative costs.

7.2. You will be permitted, subject to a Transfer Charge, to transfer onto another course between two [2] to six [6] Weeks before the Course Start Date only if a replacement student is found during this period.

7.3. Students can transfer a maximum of two [2] times. JFBS reserves the right to retain all monies paid by the Client if after two [2] transfers they are unable to attend the corresponding Course.

7.4. Transfer requests must be made in writing via email to the Correspondence Address listed previously.

7.5. You may not transfer to another Course once it has started.

 

8.   Non-attendance

8.1.  Non-attendance of Courses due to illness or for personal or professional reasons does not create the automatic right to a refund, extra tuition or a transfer. However, in such an event we will, at our sole discretion consider all the circumstances and take such action that we consider to be fair and reasonable.

8.2.  Please note that if alternative options are offered additional course Fees and/or Transfer Charges may apply.

 

9.   E-policy 

9.1.  During the course you may take photographs of your own work. We would ask you not to use the work of other people on your own website without their permission. You are not permitted to take videos at the school. For the avoidance of doubt, motion or time lapse photos constitute a video.

9.2.  JBFS reserves the right to take photographs and/or videos of the students and all work produced during the Course. Such materials may be used for marketing purposes through, but not limited to, our social media channels, company literature, partners and affiliates.

9.3. Please make sure to turn your mobile devices to silent during the lessons.

9.4. Please restrict the internet for personal use. Do not participate in any online activities which are likely to bring the school into disrepute.

9.5. Do not send email messages that might be reasonably considered by recipients to be bullying, harassing, abusive, malicious, discriminatory, defamatory, and libellous or contain illegal or offensive material or foul language. Report and such instances to The School mangament.

 

10. Certificates

10.1.        To achieve a certificate of attendance you must attend at least 80% of the Course. You will be presented with a certificate at the end of the Course confirming your attendance. The name given on the Booking Form will be the one that appears on the certificate.

10.2.        If you miss the last session due to reasons for which we are not responsible, then a certificate can be sent to a nominated address at your cost. If you do not receive a certificate for reasons for which we are responsible, then it will be sent in the post free of charge.

 

11. Health and Safety

11.1.        Students are expected to follow the health and safety guidelines given at the start of each course.

 

12. Applicable Law

12.1.        These terms and conditions shall be read and construed in accordance with laws of England. Each party subject to these Terms and Conditions irrevocably submits to the exclusive jurisdiction of the courts of England over any claim, dispute or difference arising under or in connection with these Terms and Conditions.

 

13. Materials and Equipment

13.1.        The Fees of all In-Person Course includes the use of all materials and cost of flowers.

13.2.        The Fees for all Online Courses does not include the cost of flowers.

13.3.         JFBS will charge delivery costs for any Floral Packs distributed, save for subscription to the ‘Accredited Online Professional & Events Styling Floristry Course’

 

14. Liability

14.1. You have legal rights in relation to our Services that are not provided with reasonable skill and care. These Terms & Conditions do not affect these legal rights.

14.2. We are only responsible for losses that are a natural, foreseeable consequence of our failing to use reasonable care and skill, and we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the booking was made, both we and you knew it might happen, for example, if you discussed it with us during the booking process.

14.3. Death or personal injury caused by our negligence or that of our employees, subcontractors or agents does not exclude or limit in any way our liability to you, for fraud, false representation or breach of any of your legal rights in relation to our Services.

14.4. If we are prevented or delayed in complying with our obligations to you under these Terms and Condition due to your actions or failures or those of anyone acting for you, we will not be liable to you. We will also not be liable to you due to events beyond our reasonable control.

14.5. We shall not be liable for any failure or delay in the performance, in whole or part, of any of our obligations arising from or attributable to acts, events, omissions or accidents beyond our reasonable skill and control including, but not limited to, strikes, lock-outs or other industrial disputes (whether involving our workforce or the workforce of any other party), act of God, war, riot, civil commotion, terrorism, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery or heating, lighting, air conditioning or telecommunications equipment, fire, flood, storm, pandemics, epidemics or other outbreaks of disease or infection, or failure in the external supply of electricity, water or telecommunications (including Internet) connections.

14.6. In any event, we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues, lost business opportunity, lost reputation or business interruption.

14.7. In addition to the above and subject to clause 14.2, if you are a business Client: (a) we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with the Services provided; and (b) our total liability to you for all other losses arising under or in connection with the Services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the Fees that you have paid for the Services.

 

15. Website Operator

15.1.        This website is operated by The Judith Blacklock Flower School Ltd which is registered in England at 52 Suffolk Road, London, SW13 9NR.

15.2.        By visiting our site and / or purchasing something from us, you agree to be bound by the terms and conditions, including those additional terms and conditions and policies referenced herein and / or available by hyperlink (‘Terms  & Conditions’, Terms of Service’ or ‘Terms’). The Terms & Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and / or contributors of content.

 

16. Intellectual Property Rights

16.1.        All intellectual property rights regarding this website including, but not limited to, text, graphics, design, logos, photographs, images and all other materials are owned by The Judith Blacklock Flower School or by our partners or affiliates. No trademarks or content may be copied, reproduced, sold or used without our prior written consent. If you breach this Term then you must at our direction return, delete or destroy any copies of the materials you have duplicated.

16.2.        Any course handouts or associated literature is the Copyright of Judith Blacklock Flower School Limited. These are supplied for the sole purpose of supporting the training objectives of the Course and must not be used by anyone other than the Client and for the sole purpose they have been provided.

 

17. Access to and Modifications to our Site

17.1.        Prices for our Services are subject to change without notice.

17.2.        We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

17.3.        We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

17.4.        In using our site you agree to act in accordance with the law and accept and abide by all of our Terms & Conditions. You may not alter, amend, impair or interfere with our website in any way. If you default negligently in any obligations set out in these terms and conditions (including our privacy policy and all other related documents) you shall be liable for all losses and damages that this may cause to The Judith Blacklock Flower School and our affiliates, partners or licensors.

 

18. Prices

18.1.        The price of any or all of our Services and Products will be as quoted on our website except in cases of obvious error and are liable to change at any time. All of our prices given on our website are inclusive of VAT at current rates. All prices are exclusive of delivery costs.

 

19. Refusal of Transaction

19.1.        We reserve the right to refuse to process an order for any reason or refuse service to anyone at our sole discretion and at any time during the order process.

 

20. Ordering Online

20.1.        Upon placing your order online you will be sent a confirmation e-mail detailing your order and confirming the value of your order, which will have been debited from your credit or debit card.

20.2.        By placing an order through our site, you warrant that you are legally capable of entering into binding contracts.

 

21. Errors, inaccuracies and omissions

21.1.        We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.

 

22. Prohibited Uses

22.1.        In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

 

23. Gift Vouchers: Special terms and conditions

23.1.        Gift vouchers are purchasable online but are not redeemable online. To book a Course using a gift voucher, please call our order line on 020 7235 6235. The Client must present the voucher at the school on the day of commencement of your Course.

23.2.        Unused Gift Vouchers are valid for one year and Courses must be booked before expiry of this period. For the avoidance of doubt, this does not preclude the Course Start Date being after the expiry period.

23.3.        Recipients of Gift Vouchers can be changed at any time after purchase. Cancellation of a Gift Voucher will incur a £30.00 administrative charge. The remaining amount will be refunded.

 

24. Use of Personal Data

24.1.        The personal data that we collect from you is: your first name, surname, address, town, postcode, email address and when provided additional booking notes, gender and age group and the Course booked. We promise to keep your data safe and secure.

24.2.        Your personal data will not be given or sold to any third party. Judith Blacklock Flower School collects personal data to operate effectively and for you to have the best experience with our products. Your data is used for your course booking and for you to access your online account. Occasionally, Judith Blacklock Flower School might email you with updates, course information from the school or any other news deemed of interest to you.

24.3.        You withhold the right to delete your online account at any point. If you no longer wish for Judith Blacklock Flower School to hold your personal data, please contact us at school@judithblacklock.com.

24.4.        Your data will be held under English law and will be kept until you tell us otherwise.

24.5.      We regularly review, and where necessary, update our privacy information, which will be updated on our website. If we plan to use personal data for a new purpose, other than indicated above, we update our privacy information and communicate the changes to individuals before starting any new processing of your personal data.

 

25. Complaints

25.1. We take all complaints about the standard of our service seriously. They provide us with valuable feedback to enable us to improve. If you have a formal complaint or concern, please contact: school@judithblacklock.com. We will acknowledge your complaint within two working days and aim to provide you with a full response within 10 working days. We will let you know if it will take longer than this.

25.2. If you have cause to complain, you will be able to raise concerns confidentially and expect that your complaint will be dealt with sympathetically, promptly and professionally. You have the right to appeal against any decision, assessment outcome or complaint outcome if you are not satisfied with the original response.

25.3. If a complaint from or on behalf of a student remains unresolved after consideration by The School, there is provision for resolution of the complaint using an external idependant adjudicator: the British Accreditation Council (BAC) which can be contacted at Phone: (UK) 0300 330 1400 or Email: info@the-bac.org

 

26. COVID – 19

We ask anyone who is displaying strong symptoms of COVID to take a test and if they test positive to not attend the course until a negative test has been given. There will be an admin charge to change to another date for your course subject to availability. This will be £65.

 

27. Under 16’s 

A member of the admin staff has the documentation and authority for safe guarding under 16 year olds at the school.
